Deep Hat Privacy Policy

We at Usable Machines, Inc. dba Kindo (“Kindo,” “we,” “us,” or “our”) respect your privacy and are committed to protecting the Personal Information you provide us. This Privacy Policy describes the types of Personal Information we collect and our practices for using, maintaining, sharing, and protecting it when you interact with Deep Hat at DeepHat.ai (the “Platform”). The Privacy Policy also describes the rights and choices you may have with respect to your Personal Information and how you may contact us about our privacy practices. 

By accessing or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy, the Terms of Use, and applicable laws and regulations. If you are accessing or otherwise using the Platform on behalf of an organization, you represent, warrant, and confirm that you have the authority to bind the organization to the Terms of Use, Privacy Policy, and any applicable laws and regulations, and in such event, acknowledge and agree that “you” and “your” will refer and apply to you and the organization on whose behalf you are acting. If you do not agree to these terms, you must refrain from accessing or using the Platform. 

In order to access and use the Platform, you will have to create an account by providing Account Credentials. You may choose to sign-in to access and use the Platform using your Google or GitHub account (“Third-Party Account”). By signing-in using your Third-Party Account, you are authorizing us to collect, store, and use, in accordance with this Privacy Policy and Terms of Use, any and all Account Information that you have authorized the third-party account provider to provide to us. We use the Account Information to process the creation of your account, including to verify your identity and to manage your account, including your transactions.

If you purchase the Pro Model, you will need to provide certain additional information, which may include credit card number, expiration date, security code, billing address, billing zip code, activation code, bank information, and similar information (“Billing Information”). This will be collected and processed by our Third-Party Payment Processor pursuant to the terms and conditions of their privacy policies and terms of use. We do not directly obtain, store, or process Billing Information.

1. TYPES OF PERSONAL INFORMATION WE COLLECT

“Personal Information” means any information directly or indirectly relating to an identified or identifiable individual. Personal Information may not include deidentified or aggregate information, certain publicly available information, or information covered by other legal frameworks.

In the course of operating the Platform and/or interacting with you, we may collect and/or receive the following types of Personal Information, which you authorize us to collect and/or receive:

  • Contact Information (including name, username, email address)
  • Account Information (including name, profile image, email address, date of birth, gender)
  • Generated Content (including Platform input and output, file uploads, feedback)
  • Technical Details (including Internet Protocol (“IP”) address, geolocation information, browser settings, operating system settings, device identifiers, cookies)
  • Communication Information (If you communicate with us, we may collect your name, contact information, and the contents of any messages you send)
  • Other Information You Provide (Any other information that you choose to share with us when interacting with the Platform)

2. HOW WE COLLECT PERSONAL INFORMATION

We may collect Personal Information using the following methods:

  • Directly from you when you provide it to us through the Platform or your communications with us
  • From sources that you provide or are publicly available online or in other formats
  • From third-party vendors and providers, including data analytics service providers
  • Automatically through certain tracking technologies (such as cookies, web beacons, or log files), including over time and across third-party websites or other online services

3. HOW WE USE PERSONAL INFORMATION

We may use your Personal Information as set forth below:

  • Provide, operate, administer, and maintain the Platform
  • Monitor, support, analyze, and improve the performance and functionality of the Platform
  • Evaluate access and use of the Platform
  • Communicate with you regarding the Platform
  • Research, project planning, and troubleshooting related to the Platform
  • Detect and protect against error, fraud, abuse, or unauthorized activity
  • Protect the safety and security of the Platform, IT systems, architecture, networks, and users
  • Anonymize and aggregate information for analytics and reporting
  • Comply with legal obligations, legal process, contractual requirements, and internal policies, practices, and processes
  • Short-term transient use, as defined in the California Consumer Privacy Act.
  • Training and quality assurance.
  • For any other purpose with your consent

Unless otherwise requested or required by an authorized end user, we do not intentionally seek out Personal Information to train our models; however, our training information may incidentally include Personal Information. We utilize training data to enable our models to learn about language and improve their understanding and responses. In doing so, we have implemented measures to seek to minimize the handling of Personal Information in our model.

4. HOW WE SHARE PERSONAL INFORMATION

In certain circumstances, we may share Personal Information with third parties without further notice to you unless otherwise required by law:

  • To third-party contractors, vendors, and service providers that provide services to us in the operation of our business and assistance with the Platform, such as technical support, payment processing, Platform security, and data analytics
  • To enforce or apply our Terms of Use, Privacy Policy, and/or other agreements 
  • To comply with any court order, law, or legal process, including government or regulatory requests
  • To our parent company, subsidiaries, affiliates, or other companies under common control with us 
  • To advisors, consultants, auditors, or similar professionals to assess our business, financial, and legal obligations, or operations
  • To a buyer or other successor in the evaluation and/or event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets
  • If we believe it is necessary to protect our rights, property, or safety
  • For any other purpose disclosed by us when you provide Personal Information
  • With your consent, such as when you choose to provide your information to third parties

When possible, we take reasonable measures to seek to require third-party providers and vendors receiving Personal Information from us to: (a) retain and use such information for the specific business purpose(s) for which the Personal Information has been provided to them; (b) not disclose Personal Information except with our authorization, as permitted by applicable law, or as permitted by this Privacy Policy; and (c) use reasonable and appropriate measures to safeguard the Personal Information.

5. COOKIES AND AUTOMATICALLY COLLECTED DATA

A cookie is a small file that can be stored on your computer or mobile device by us or third parties when you use the Platform. Cookies collect data that includes Personal Information. Cookies can be in the form of session cookies or persistent cookies. Session cookies are deleted from your computer or mobile device when you close your browser. Persistent cookies will remain stored on your computer or mobile device until deleted or until they reach their expiration date. Browser Independent cookies, such as local and/or session storage and interaction requests, store certain data on your computer or mobile device with no expiration date. Despite the fact that these requests do not set any cookies, they can still transfer information to first or third parties. 

We use cookies with the Platform for the following purposes: 

  • Essential: Some cookies are strictly necessary, and we use them  for the Platform to function, for example to ensure you can move around and use it effectively. They are only set in response to your actions when you request services, such as cookies that enable you to log into secure areas of the Platform. 
  • Performance/Functionality: Cookies, web beacons, and IP address logs allow us to measure and improve the performance of the Platform. For example, we may collect information in the aggregate to give us insight into how the Platform is being used, such as what website you came from, how you interact with the Platform, how long you were on the Platform, and what type of browser you are using. We also may use these cookies to serve new and different content and to test new features. 
  • Personalization: These cookies allow us to recognize you when you visit the Platform, personalize your experience, and generally to serve you better. 

You may disable or delete browser cookies through your browser settings. Cookies are generally easy to disable or delete, but the method varies between browsers. If you disable or delete cookies, or if you are running third-party software that intercepts or deletes cookies, please note that some parts of our websites may not work properly.

The Platform currently does not respond to “Do Not Track” requests through mechanisms such as web browser signals. However, you can opt out of third parties collecting your Personal Information for targeted advertising purposes by visiting the National Advertising Initiative’s opt-out page and the Digital Advertising Alliance opt-out page and in the EEA by visiting The Programme’s  opt-out page. You may also adjust advertisement and privacy preferences through your social media accounts. You may also opt out of certain Google Analytics activity by installing a Google browser extension, available here.

6. HOW WE PROTECT YOUR INFORMATION

We take reasonable technical, administrative, and organizational measures to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of the platform, nor can we guarantee the security of information transmitted through the Internet. Where you have chosen a password, you are responsible for keeping this password confidential.

7. CHILDREN’S PRIVACY

The Platform is not intended for children under 16 years of age, and we do not knowingly collect Personal Information from children under 16. If you are under 16, do not use or provide any information on the Platform. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete it. If you believe we might have any information from or about a child under 16, please Contact Us using one of the methods specified below.

8. THIRD-PARTY EXTERNAL SITES

When using the Platform, you may choose to interact with features from third parties that operate independently from the Platform, such as links to third-party websites, as well as third-party resources and services. We have no control over and are not responsible for the privacy practices of such third parties and recommend that you familiarize yourself with the privacy practices of these third parties.

The Platform and its output may contain links and connections to third-party websites, resources, and services. These links and connections are provided solely as a convenience to you and not as an endorsement by us of the content on such sites, resources, and services. The content of such third-party sites, resources, and services is developed and provided by others. You should contact the administrator for those external sites, resources, and services if you have concerns or questions regarding the links or any associated content. We are not responsible for the content of any linked external sites, resources, and services and do not make any representations or warranties regarding the content or accuracy of materials on third-party external sites, resources, and services. You should take precautions when downloading files from all third-party sources to protect your computer from viruses and other destructive programs. If you decide to access linked external sites, resources, and services, you do so at your own risk.

9. DATA LIFECYCLE

We will retain your Personal Information only for as long as is reasonably necessary for the purposes set out in this Privacy Policy and the Terms of Use; for as long as your account is active; as needed to provide, administer, maintain, operate, and support the Platform; and to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and as otherwise described in this Privacy Policy. How long we retain Personal Information will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements.

10. MANAGE YOUR PERSONAL INFORMATION

You may manage your Personal Information by making certain choices depending on applicable law. If you believe that any Personal Information you have provided to us is out-of-date or inaccurate, you seek to correct such information by contacting us through one of the methods designated in Section 14 (Contact Us). You may also have additional rights detailed below depending on where you live. As a security precaution, we may need to request information from you to help us confirm your identity when exercising a right related to your Personal Information. 

Given the technical complexity of how our models work, including the reasonable accessibility of model data, we may not be able to validate the presence of or correct an inaccuracy regarding Personal Information in every instance, nor may we be able to delete certain Personal Information in the model.

Only you, or someone legally authorized to act on your behalf, may make a verifiable request related to your Personal Information. To make a request on your behalf, an authorized agent may Contact Us by email with proof of your written and signed permission to do so. Note that we may also require you to verify your identity and confirm that you gave permission.

11. CROSS BORDER DATA TRANSFERS

We may transfer the Personal Information we collect about you to countries other than the country in which the information originally was collected. Those countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your Personal Information to other countries, we will protect that information as described in this Privacy Policy and in accordance with applicable law. Where appropriate, we use contractual protections for the transfer of Personal Information among various jurisdictions.

12. JURISDICTIONAL SPECIFIC NOTICE

If you choose to access the Platform from outside the United States, you acknowledge that you may be transferring your information, including personal information, outside of those regions to the United States for storage and processing, as necessary to provide, administer, and operate the Platform.

  1. Additional Notice to California Residents

We collect the Personal Information identified in Section 1, which falls into the following categories of Personal Information according to the California Consumer Privacy Act (CCPA):

  • Identifiers 
  • Commercial information
  • Internet or other electronic network activity information
  • Geolocation data
  • Inferences
  • Sensitive Personal Information, including login credentials and the contents of messages sent through the Services

As described in more detail in Section 2, we collect Personal Information from the following categories of sources:

  • Directly and indirectly from you 
  • Service providers 
  • Companies with public websites

We disclose the following categories of Personal Information for the business or commercial purposes identified above in Sections 3 and 4 with the following categories of third parties in the 12 months preceding the date this Privacy Policy was last modified:

We do not sell any Personal Information to third parties, nor do we share Personal Information for targeted advertising or direct marketing with third parties (and have not done so in the preceding 12 months or otherwise).

If you are a resident of California, you have the right to: (i) request that we disclose what Personal Information we collect, use, disclose, and sell; (ii) request deletion of Personal Information, subject to certain exceptions; (iii) request that we correct inaccurate or incomplete Personal Information; (iv) opt-out of the sale of Personal Information; (v) opt-out of the “sharing,” or disclosing Personal Information for the purposes of cross-context behavioral advertising; and (vi) not receive discriminatory treatment by us for exercising these rights.

As a California resident, you have the right to request that we disclose the following information: (i) specific pieces of Personal Information we have collected about you; (ii) categories of Personal Information we have collected about you, disclosed about you for a business purpose, or sold; (iii) categories of sources from which the Personal Information is collected; (iv) categories of third parties with whom we share or to whom we sell Personal Information; and (v) the business or commercial purpose for collecting, selling, and sharing Personal Information.

We do not have actual knowledge that we sell or share the Personal Information of consumers under the age of 16.

We do not use or disclose Sensitive Personal Information for purposes other than those specified in Cal. Civ Code § 1798.121.

To make a request to exercise an applicable right, please follow the instructions in Section 12.e Exercising Your Rights below.

  1. Additional Notice to Certain Other U.S. Residents

If you are a resident of certain other U.S. States, you may have some or all of the following rights. These rights are based on verifiable residency status, and we reserve the right to honor your request to exercise these rights based on your residency and application of state law. You may have the right to request the following: (i) that we disclose and provide a copy of what Personal Information we collect, use, disclose, and sell; (ii) that we delete your Personal Information, subject to certain exceptions; (iii) that we correct inaccurate or incomplete Personal Information; (iv) opt-out of the sale of Personal Information; (v) opt-out of targeted advertising; (vi) opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects about you, and (vii) not receive discriminatory treatment by us for exercising these rights. 

To make such a request, please follow the instructions in Section 12.e Exercising Your Rights. If you are appealing our decision, please attach information to identify your original request. In order to verify your request, we may require you to provide additional information to confirm your identity.

  1. Additional Notice to European Economic Area (EEA) and United Kingdom Residents

Where we need to collect Personal Information by law or under the terms of a contract we have with you and you fail to provide that information when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may have to cancel a product or service you have with us but will notify you first.

We rely on the following lawful bases to process your Personal Information for these non-exhaustive purposes:

  • Consent. We may obtain your consent to process your Personal Information in certain circumstances, which may include when you interact with the Platform. 
  • Performance of a Contract. We rely on this lawful processing ground when we process your Personal Information to perform a contract which we have with you, or when we take steps in anticipation of entering into a contract with you, for example in connection within the provision of services to you and the management of our relationships with third parties.
  • Compliance with a Legal Obligation. We rely on this lawful processing ground when we process your Personal Information to meet legal and regulatory obligations which apply to us.
  • Legitimate Interests. We rely on this lawful processing ground when we process your Personal Information to provide, operate, administer, and maintain the Platform; to respond to specific requests; to manage our business operations; to manage our relationships with you and with third parties in connection with our business; and when we provide you with information in relation to our services which we believe may interest you.

If you live in the EEA or United Kingdom, we may transfer Personal Information to countries for which adequacy decisions have been issued, and may use contractual protections for the transfer of Personal Information to third parties. You may Contact Us to obtain additional information regarding the transfer of your Personal Information outside of the EEA or United Kingdom.

If you live in the EEA or United Kingdom, you may have the right to: (i) request access to, rectification, or erasure of your Personal Information or restrict the processing of your Personal Information; (ii) object to processing; (iii) data portability (receive and transfer your Personal Information); (iv) lodge a complaint with a supervisory authority; and (v) where processing of your Personal Information is based on consent, withdraw your consent at any time without affecting the lawfulness of the processing of Personal Information that occurred before you withdraw consent.

  1. Additional Notice to Canada Residents

We may use service providers located outside of Canada, including, without limitation, in the United States of America, to process Personal Information, and may transfer your Personal Information to such service providers for this purpose. When your Personal Information is processed outside of Canada, it will be subject to the laws of the countries where the information is processed and may be accessible to law enforcement and national security authorities of those countries in accordance with their laws.

You may Contact Us to obtain information about our policies and practices regarding the use of service providers located outside of Canada.

If you live in Canada, in addition to the other rights you may have hereunder, you may have the right to: (i) request access to, review and to correct inaccuracies or omissions in your Personal Information; (ii) to withdraw consent for collection, use or disclosure of, or to request deletion of, your Personal Information (provided that, if you do so, we may no longer be able to provide services to you that rely on such Personal Information); (iii) to ask questions about our policies and practices, and to lodge complaints about our compliance with them with us or with regulatory authorities; and (iv) for Quebec residents, to request an electronic copy of the Personal Information you have provided to us in a structured and commonly used technological format.

To make a request, please Contact Us using one of the methods specified below in Section 14. In order to verify your request, we may require you to provide additional information to confirm your identity. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. To make a request on your behalf, an authorized agent may Contact Us by email with proof of your written and signed permission to do so. Note that we may also require you to verify your identity and confirm that you gave permission.

13. UPDATES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may update this Privacy Policy and without prior notice to you to reflect changes in our privacy practices. We will indicate at the top of this Privacy Policy when it was most recently updated, and we encourage you to revisit this page periodically to stay aware of any changes. By accessing the Platform after we change this Privacy Policy, you are deemed to have accepted such changes.
